This order should have shipping fee based on a subtotal of 52-13= 39€, after discount added and before the pay on delivery fee.

The built-in Free Shipping only ever uses the cart sub-total, so to change that you can use something like Total-Based Shipping. It can factor in previous line items on the order into the total it checks, so you can give free shipping after certain discounts have been taken into account. For example, you'd first set the sort order of your line items to do this:

Sub-Total
Discount
Shipping
Fee
Total

and then set up a rate in Total-Based Shipping like this:
