If in settings, I have said "No" to "stock checkout" then:
If a product is out of stock, "Out of stock" message should replace the "Add to cart" button.

Even better would be to have definable options for the 4 stock statuses instead of having 2 useless ones.

You should be able to define checkout for Pre-order yes/no; Out of Stock yes/no (this is in 1.5.6), 2/3 days yes/no etc.

This should also allow us define what buttons and button text are shown on the site (eg: out of stock greyed out, non clickable; 2/3 days clickable but a different colour, button says 2/3 days; pre-order clickable, different colour, button says Pre-Order...)

Why have statuses if you cannot configure them to actually do anything?!

This would allow for maximum flexibility on configuration and would therefore make OpenCart far more attractive "out of the box".
