that is an osCommerce site that is selling custom versions of osCommerce. Not OpenCart.

Even if they were - they simply have to state that they're selling their own custom changes of the software, not the software itself. OR they could simply be charging for installation.etc. Lots of ways to use OpenSource code and sell it onto others. Half the world does it (think linux server installations )

However, you can't simply take an OS product, then re-sell the PRODUCT. Then you have legal problems.
