With the 1st of October 2019 the EuGH has made an important decision about Cookies and the Consent about.
See: http://curia.europa.eu/juris/document/d ... id=1495672
This decision confirms the already existing GDPR (since 25. May 2018).
In short:
website visitors must have actively the chance to optin (consent) to store cookies.
Already marked checkboxes or no option to check is NOT allowed and can be punished.
Also not allowed the current everywhere displayed cookie banners with nonses as text and 1 button only to accept (= close the banner)!
And - if more than 1 button is displayed, all buttons must have the same colour - no different colours are allowed ot suggest "hey user, click that here .."
Because these banners give the visitor no option (the consent) to subscribe (allow) to store cookies and should be replaced as soon as possible.
Finally: the user has to be informed (in detail)
* which cookies are used
* the vendor (webstore itself or any other system like Google)
* the days the cookies will be stored
This is also valid for the so called "technical" cookies were no consent must be given because they are needed for proper operation (like currency, language, session).
