Registration Issues - RESOLVED

i currently run a store on 1.5.6.4 and im looking to upgrade to 2.1.0.2 everything has gone fairly smooth, however.....
when a user tries to checkout as they are presented with the login/register account screeen, or checkout as a guest. no matter what option they select the Region/State field is blank, (mathewbuer.uk/dss/index.php?route=checkout/checkout)
however if i visit the registration page directly i am able to select the region/state field.

has anyone else has this issue ? or know of a fix.
Opencart has been updated from 1.5.6.4 > 2.1.0.2
if i install 2.1.0.2 and try this again there is no problems.
