OC 2.1.0.1 Payment Method on Checkout Page Error?

In the payment method step during checkout, if a customer doesnt Accept the "terms and conditions" and clicks continue the button becomes disabled Keeping the customer stuck at that step.The customer cannot again accept the "terms and conditions" and continue with the checkout.
