The title of this thread needs to be changed. Selling GPL software is not illegal at all. You guys may have heard of a billion dollar company by the name of redhat that does this. Also all wordpress, drupal and open cart extensions and themes are by default gpl so if selling them were illegal they might as well shut down the whole premium website theme/plugin industry.

It is not illegal, immoral or unethical. If you choose to license your work under the GPL then you choose to allow people to sell your work. Coming back later and saying "no I didn't know this" or "it is illegal" or such BS will not fly. Ignorance is no excuse. It could certainly violate copyright if the license and original author credits were removed. Also CodeCanyon/ThemeForest stated they would prohibit developers/designers from selling GPL software that wasn't their own so that solves the issue definitively in this case.
