Upgrading to 1.4.9.4 problem

After the upgrade I see the following error

Warning: require_once(DIR_SYSTEMstartup.php) [function.require-once]: failed to open stream: No such file or directory in /home/lakeshop/public_html/install/upgrade.php on line 12

Fatal error: require_once() [function.require]: Failed opening required 'DIR_SYSTEMstartup.php' (include_path='.:/usr/lib/php') in /home/lakeshop/public_html/install/upgrade.php on line 12

What are you upgrading from? Looks like you overwrote your config.php files so it can't find the path to DIR_SYSTEM. You'd best restore your backup and read the instructions carefully, especially the part about not overwriting existing config.php files.

This tells me either you didn't upload one or both of these files:
admin/controller/setting/setting.php
admin/language/english/setting/setting.php

This looks like my vQmod for showing the product name in the header of the product edit page

Neither appear to be bugs with opencart. The vQmod for the second one may need to be altered tho on my site with that same vqmod it just shows an empty space instead of that error.

both setting files are in the appropriate directories.

every so often I lose my theme and it goes back to the default template and the setting/store template dropdown no longer works

I have to restore the databse
