The t&c's are opening in a new window (or tab depending on your browser). Don't click continue just close it.

Agreed this is potentially confusing perhaps some kind of cutdown page (with agree or cancel buttons) in a thickbox type popup would be better.

New or edited customer address always becomes the default

Login as a customer and add a second address, but don't opt to make it the default. Go back to edit this address and you'll see it's now the default.
