Download the VQmod I posted earlier
Install that then go to Catalog/Filters and add a set
add FIlters to some products
Install a Filter Module somewhere and it should self populate

vqmod, from code by robertiulianstoica, to get filters directly from the products without having to put them in the categories
Either just the selected category or that category and its sub-cats. Comment out as appropriate

I've done a version of this using jquery so it appears when added to and hides if you empty it
It's a bit of a hack but seems to work though I haven't tested it extensively

but it appears unchanged in the latest download still, looking at the source a code, though I haven't tried it in situ
It doesn't freeze for me. Just tries to load an whole page in the DIV

Anyway I made a vQmod for it but it really needs fixing

Sorry
If you are using nytevizion's code as above then change 'upload' in my code to 'file'
Put the validation in the form validate() function
Put the delete right after $mail->send();
Hope that makes sense

I always thought it should be like this by default to save you setting the parent
Works on 1.5.2.1 - I imagine it will work on most others

trouble is it doesnt then immediately reappear when cart added to via ajax
It may be better to hide it with css and then easier to display when required
